<br />DRAFT SUBDIVISION ORDINANCE <br /> <br />>,<,,'''' <br />,,7.>'1 <br />.:~&"l <br /> <br />(4) <br /> <br />87 <br /> <br />002354 <br /> <br />5-420 <br /> <br />Qr paid to the order of the depositor without <br />payment of interest by the governing body. <br /> <br />Prior to offering any improvement to the govern- <br />ing body, the subdivider furnishes a written <br />guarantee that all indebtedness incurred for <br />supplies, material, labor furnished, or engineer- <br />ing and professional services in the oonstruction <br />of improvements sh~lrhave been paid in full and <br />that there are no claims for damage or suits <br />against the contra~tQr involving such improve~ <br />ments. <br /> <br />4.21 <br /> <br />4.2 Building Site Improvements <br /> <br />4.22 <br /> <br />4.23 <br /> <br />4.24 <br /> <br />-'.-~", <br />(;2;') <br /> <br />No subdivision or part thereof shall be approved if proposed <br />subdivision development in a floodway will, individually <br />or collectively, significantly increase flood flows, heights, <br />or damages. <br /> <br />No subdivision or part thereof shall be approved for floodway <br />or floodway fringe areas which will substantially affect the <br />storage capacity of the flood plain. <br /> <br />Building sites, residences, motels, resorts and similar <br />uses for human occupation shall not be permitted in floodway <br />areas. Sites for these uses may be permitted outside the <br />floodway if the sites are elevated to a height at least <br />foot above the elevation of the regulatory flood or provis ions <br />otherwise made for elevating or adapting structures to <br />achieve the same result. Required fill areas must extend <br />fifteen feet beyond the limits of intended structures and, <br />if the subdivision is not to be sewered, must include areas <br />for onsite waste disposal. <br /> <br />Buildino sites for structures other than residences <br />outside"of floodway areas shall ordinarily be <br />filled as provided in 4.23. However, the <br />may allow subdivision of areas <br /> <br />(reviCVl ag'ency) <br />for con~ercial and industrial use at a lower ele- <br />vation if the subdivider protects the areas to a <br />height of foot above the regulatory flood <br />protection elevation by levees, seawalls, channel <br />modifications, or other protective techniques; or <br />if the subdivider agrees to protect uses through <br />structural flood-proofing, flood warning systems <br />or'other techniques specified in Sec,tion 5. <br />
