WAIVER OF SUBDIVISION REQUIREMENTS OR ZONING REGULATIONS

In spccialciroumstances it is desirable to waive or
modify subdivision or zon~ng requirements. For example, a
relaxation of minimum elevation requirements for building sites

on lots in flood-prone areas maybe appropriate for portions

of commercial or industrial subdivisions used for storage,
parking lots, or struoturally flood-proofed buildingl.l 4 Some

subdivision oontrol enabling acts specifically 'authorize the

subdivision review agency to waive general rules in special
oiroumstanoes.1l5 Waivers and modifications have been upheld
. . t 116
1n some 1ns ances.
In speoial circumstances zoning "variances,,117 may also

be ~vailable ~o permit subdivIsion US8S not in compliance ~ith

zoning ordinances. However, the landowner 'seeking a zoning

variance must usuall~.meet rigorous tests including a showing
of severe economic hardship and special ciroumstances.118

But in some instances where these tests could not be met,

,. .
modifications are nevertheless deolLable to promote sound

subdivision practices such as. utilization of' upland areas as
, "cluster" building sites whj~le preserving lower flooded areas
as open space.119 Cluster subdivisions, whioh have been dis-,
cussed in section 5-240(10), often 'require modifi-

cation in zoning requirements for minimum lot sizes, yards,

roads and so forth. Several subdivision control acts speci-

fically permit subdivision review boards to amend zoning

ordinances to permi'c such "planned unit developments. ,,12 0

'i;j~~)
