WAIVER OF SUBDIVISION REQUIREMENTS OR ZONING REGULATIONS <br /> <br />In spccialciroumstances it is desirable to waive or <br />modify subdivision or zon~ng requirements. For example, a <br />relaxation of minimum elevation requirements for building sites <br /> <br />on lots in flood-prone areas maybe appropriate for portions <br /> <br />of commercial or industrial subdivisions used for storage, <br />parking lots, or struoturally flood-proofed buildingl.l 4 Some <br /> <br />subdivision oontrol enabling acts specifically 'authorize the <br /> <br />subdivision review agency to waive general rules in special <br />oiroumstanoes.1l5 Waivers and modifications have been upheld <br />. . t 116 <br />1n some 1ns ances. <br />In speoial circumstances zoning "variances,,117 may also <br /> <br />be ~vailable ~o permit subdivIsion US8S not in compliance ~ith <br /> <br /> <br />zoning ordinances. However, the landowner 'seeking a zoning <br /> <br />variance must usuall~.meet rigorous tests including a showing <br />of severe economic hardship and special ciroumstances.118 <br /> <br />But in some instances where these tests could not be met, <br /> <br />,. . <br />modifications are nevertheless deolLable to promote sound <br /> <br />subdivision practices such as. utilization of' upland areas as <br />, "cluster" building sites whj~le preserving lower flooded areas <br />as open space.119 Cluster subdivisions, whioh have been dis-, <br />cussed in section 5-240(10), often 'require modifi- <br /> <br />cation in zoning requirements for minimum lot sizes, yards, <br /> <br />roads and so forth.
