These may include agreementsbeb:een the <br /> <br />subdivider and planning board as to future use of the land. <br />126 <br />For example, a South Carolina act provides that: <br /> <br />47-1087. Agreements as to use, height of buildings, <br />etc. The commission may agree with the applicant upon <br />the use, height, area or bulk requirements or restrictions <br />governing buildings and premises within the subcivision, <br />. provided such requirements or restrictions do not . <br />authorize the violation of the then effective zoning <br />ordinance of the municipality. Such requirements or <br />restrictions shall be stated upon the plat prior to <br />the approval and recording thereof and shall have the <br />same force of law and be enforceable in the same manner <br />and with the Sffine sanctions and penalties and subject to <br />the power of amendment or repeal as though set out as a <br />part of the zoning ordinance of the municipality. <br /> <br />This is an important power because a board might allow a <br /> <br />range of adjustments to flood hazards on proposed subdivision <br /> <br />lands if it could be assured that the land was not to be used <br /> <br />for residential use or that uses were to be flood-proofed. <br /> <br /> <br />The draft ordinance proposed in Chapter IV of Part V permits <br /> <br /> <br />the review agency to attach a range of conditions to plat <br /> <br /> <br />approval including agreements or deed restrictions pertaining <br />-. <br /> <br />to future use. <br /> <br />
