CHAPl'ER 1 - GENERAL INFORMATION

1. Al1I'HORITY AND SCOPE

a. This l"t!port on reservoir regulation for flood control, Paonia
Reservoir, Muddy Creek (tributary to Horth Fork Glmnison River), Colorado,
is prepared in accordance with instructions contained in ER 1110-2_240,
EM 1110_2_3600 and EC 1110-2-67, vhich l"t!quire a report on l"t!BerVoir regu-
lation far flood. control for all reservoirs covered by Section 7 of the
Flood Control Act of 1944 (58 Stat. 890). The pertinent portion of that
act reads as follow:

to prescribe regulations for the use of storage allocated
for flood control or navigation at all reservoirs constructed
vholly ar in part with Federal Funds provided on the basis of
such purposes, and the operation of any such project shall be

b. This report contains descriptive infanaation about the project, the
method of operation, and the proposed regulations for flood control operation.
Location of the project is shovn on chart 1. A considerable portion of the
IIILterial used in the preparation of this report ws supplied by the United
States Bureau of Reclalllation, Region 4, Salt lake City, Utah.

2. At1I'HORIZATION

(

a. The Paania Project was approved by the president on 18 IoBrch 1939,
but _s not constructed under that authorization. The act of June 25, 1947
(61 Stat. 181) authoriZed construction of the project in accordance \11th
the (Bureau of Reclamation) Regional Director's report dated 2 January 1946.
The project 'o/8s reauthorized as a participating project under the Colorado
River Storage Project Act of 11 April 1956. (70 Stat. l05)

b. The monetary contribution by the Federal Government tmoard the con-
struction cost of Paonia Dam and Reservoir in the interest of flood control
did not require a formal congressional authorization because, on the basis
of proportional benefits, benefits attributable to flood control operation
\/ere small.

c. Thl! amount of contribution for flood control \/as estimated at
$75,000 by the U. S. ArMy, Corps of Engineers, as stated in an office letter
from the District Engineer, Los Angeles District, to Regional Director,
Region 4, Bureau of Reclamation, Ss.lt lake City, Utah, dated 13 August :uJ56
