<br />9. Findillgs of jact by the Administration

<br />(a) A special Telephonic Meeting of the Administration was held
<br />on May 18th. 1960, in accordance with Article IV, Section 3B. of the
<br />By-La\vs for the purpose of declaring the Reservoir empty and giving
<br />notice to the State Engineer of Colorado that priority administration
<br />would commence on May 28th, 1960, unless a change of condition
<br />justified cancellation or modification of that notice. Priority administra-
<br />tion should commence. and decreed rights of water users in Coloraclo
<br />would be administered by the C(l!orado State Engineer. The Resen'pir

<br />(b) On Tuesday night. July 5th, some heavy rains occurred in
<br />the vicinity south of the John Mrtrtin Reservoir causing Caddo::!. Creek
<br />and Rule Creek to flood, About 7 A. M, July 6th Mr, McGr"th notified
<br />the Secretary that there WilS considerable flood water at the Fort Bent
<br />head gate. Under closer investigation it was founcl that most of the flood
<br />\Wltcr was coming from Caddoa Creek and Rule Creek. It \Vas aJ.:;n
<br />discovered that the discharge from John Martin Reservoir had reached
<br />2300 cu. ft. per second at approximately 11 A. M.
<br />

<br />As :1 result of this meeting the administration found that stofl:d

<br />and the State Engineer of Colorado WJS notifieu. to that cffect, On July
<br />7tn t'his notice was modified to extend the supply to '2 Noon, July 9tn,
<br />and agClin extendeJ to Tuesday, July 12th, 1960, The Reservoir \\'.lS
<br />empty Tuesday A. M" July 12th. 1960, sometime before 8 A. M,
<br />
<br />(c) Wednesday morning. July 13, 1960, the secretary wa:, In'
<br />formed that a considerable amount of water was passing the Fort Lyul1
<br />Canal dam in the Arkansas River. Also about 2000 cfs \V;1S in the
<br />Purgatoire at the Nine: Mile sOllth of Las Animas, \Vith this informa-
<br />tion at hand, a telephonic meeting was held at 12 :30 P. M., July 1 ~th,
<br />1960, in accordance with Article IV, Section 38 of the By-L1\vS of the
<br />Administration.

<br />As a result of this meeting <ImI upon further investigation th\..' ild-
<br />ministration found th;:tt water \Vas available for Colorado District ~7
<br />and Kansas, The gates were adjusted at 9 P. M. on July 13th to limit
<br />the discharge to 600 efs, Storage began at 10:30 A,M, July 14th. and
<br />the State Engineer of Colorado was notified to th:tt effect. The reservoir
<br />was emptied 'at 3 :00 A. M, on July 17, 1960,
<br />
<br />There being no water available for storage during the remainder
<br />of the water year, the river was administered by the State Engineer.
<br />Colorado continued to call for 100 cfs. up to December 1st. 1960, ;1.5
<br />proviued in Article V, paragraph A of the Compact Administration.
