<br />B-19 <br /> <br /> <br />002794 <br /> <br />f <br /> <br />cipation in that suit. Ralph is here this morning. Ralph has been <br />our Counsel for twelve years or so, or something like that. The <br />other one I want to mention, is sort of an expansion of Manny's <br />Report, The State is involved in it as well as the Solicitors Office <br />of the Department of Interior. You all are, I'm sure, familiar <br />with the Kennedy Bill that was introduced two years ago and two <br />sessions ago, and again this last session, to settle the water rights <br />of five Central Arizona Indian Tribes. The conclusion, that Bill <br />never moved anywhere and the Solicitor of Interior finally concluded <br />that you just couldn't try to settle all these cases under one umbrella. <br />That you had to deal with them reservation by reservation. We have <br />then, in Arizona under the sponsorship of the Solicitors Office, under- <br />taken negotiations with most of the Central Arizona Tribes. The <br />action, reservation and negotiations were resolved first and legis- <br />lation was then inacted by Congress during this session and signed <br />by the President just a few weeks ago that settles their claims. <br />Negotiations are actively taking place between the City of Tucson, <br />the Mines, all the other interests in Upper Santa Cruz Basin, the <br />General Tucson Area, with the Papago Indian Tribe, with regard to <br />the Reserve Water Rights of the San Xavier portion of that reserva- <br />tion. More recently, negotiations have been undertaken with the <br />White Mountain Apaches, San Carlos Apaches, the Salt River Indian <br />Reservation, and the Fort McDowell Reservation and the Camp Verde, <br />Yavapai. We've got a lot of negotiations with Indian Tribes tmderway <br />in Arizona recently. They're really just getting started so it's <br />impossible to tell at this point just how successful they will be. <br />But the real effort is going to be made to resolve these things out <br />of court, really, in keeping with the President's New Water Policy <br />in this area, For report as distributed, see PART C - ATTACHMENTS. <br /> <br />Department of Housing and Urban Development <br /> <br />Mr, Dale T, James, Environmental and Standards Office, San Francisco <br />Regional Office. Just a couple of specific items, I'll try to be brief. <br />HUD has always, at least in Region Nine, and that's California, Nevada, <br />Arizona and Hawaii, has always refused to accept subdivisions which <br />are served by individual sewage disposal systems unless all parcels <br />of that subdivision meet our percolation standards. Recently, as the <br />result of considerable Congressional pressure we lifted some of those <br />requirements, so that we can now accept individual buildings construc- <br />ted recently in subdivisions even if portions of that subdivision are <br />not acceptable, that means that you might have a 100-unit subdivision <br />. in the Sierra foothills and half of them don't meet percolation tests, <br />But if half do, we would accept that half that do meet those tests <br />for mortgage insurance, There is some dispute within the Department <br />over this policy because it obviously suggests that we might be <br />encouraging development which otherwise is not the most desirable. <br />But nevertheless, this is one of the results of the substantial pressure <br />we have been feeling for supporting construction of housing. Second <br />item of interest, As you mayor may not know, the Federal agencies <br />which are involved in the Tahoe Basin have recently completed a draft <br />policy on Federal participation in that basin, as a result of this <br />
