<br />ATTORNEY'S REPORT <br /> <br />026:1 <br /> <br />Ordwa,y, Colorado <br />January 8, 10/73 <br /> <br />The Stookholders of The Twin Lakes <br />Reservoir and Canal Company <br /> <br />Gentlemen: <br /> <br />The following is a suDlllltU7 of the status of the Company's <br />litigation as of Deoember 31, 1972: <br /> <br />1. The appeal by The Colorado River Water Conservation Distriot <br />of the Garfield County Distriot Court's award of a oonditional denree <br />for the storage of 15,000 acre feet of water from the Roaring Fork <br />River in Twin Lakes Reservoir under the Third and Fourth Enlargements <br />of that reservoir is still pending in the Supreme Court of Colorado. <br />That Court heard oral arguments in that case on November 15, 10/72, <br />but its decision has not been issued. <br /> <br />2. The Supreme Court upheld the Chaffee County District Court's <br />award of conditional decrees to the Company for the Third and Fourth <br />Enlargements of Twin Lakes Reservoir, whioh decrees had been appealed <br />by Eugene Bond. Oral arguments in that matter were held on November <br />19, 1971, and the Court issued its decision early in 1972. <br /> <br />3. The Company in 1971 joined several other ditch and reservoir <br />companies in oppOSing the application of The Booth-Orchard Grove <br />Ditch Company and the Board of Waterworks of Pueblo for a change of <br />water rights. This matter was settled by agreement during 1972, and <br />the Court entered a decree in accordance with the agreed settlement; <br />therefore, this matter is no longer peOOing. <br /> <br />4. The class action suit against the Company, which was filed <br />in the District Court of Crowley County in 10/70, is still peOOing in <br />that court. <br /> <br />5. The foreclosure suit by The First National Bank of Denver, <br />as Trustee for Connecticut Mutual Life Insurance Company against <br />The National Sugar Manufacturing Company, et al., including The Twin <br />Lakes Reservoir and Canal Company, which was filed in the Crowley <br />County District Court in October, 1971, is still pending and has <br />not been set for trial. <br /> <br />6. The partition suit filed in the Distriot Court of Lake <br />County in November, 10/71, by Eugene A. Bond against The Twin Lakes <br />Reservoir and Canal Company, et al. has been settled aOO dismissed. <br /> <br />7. The Company in May, 10/72 filed in the Water Court for <br />Division No. 5 at Glenwood Springs, Colorado, an applioation for a <br />biannual finding. of due diligence on the Transmountain Diversion <br />Water System. The Colorado River Water Conservation Distriot has <br /> <br />-4- <br /> <br />... <br />
