<br />. This table is a summary of application of the 20 coal unsuitability criteria from 43
<br />CFR 3461 to the federal coal planning area, See Appendix 2. Federal Lands Review,
<br />in the Draft RMP lEIS for more detailed information,

<br />I The unsuitability criteria are subject to exemptiqm and/or specific exceptions. General
<br />exemptions applicable to several criteria include: lands subject to valid existing rigbts
<br />(Criteria Number.; I, 3, 4 Oimited]); lands to wbicb the operator has made substantial
<br />legal and finaocial commitments prior to January 4, 1977 (all except Criteria Number.;
<br />3,4, and 19); surface coal mining operations existing on August 3, 1977 (all except
<br />Criteria Number.; 4 aod 7); and laods for whicb a mioing permit bas been issued (all
<br />but 3, 4, and 7), All criteria except 4, 5, 6, IS, 16, and 19 are also subject to one
<br />or more specific exceptions. For example, tbe exceptions to Criterion Number 11 state
<br />that a lease may be issued if stipulations can ensure that eagles are not disturbed during
<br />the breeding season, or if tbe Fish and Wildlife Service determines that the nest(s)
<br />of goldeo eagles can be moved; and the size of a buffer wne can be decreased if
<br />active eagle nests will not be adver.;ely affected, Results did not change after the exemptions
<br />were considered because the criteria were nol applied to leased lands (43 CFR 3461.4-
<br />2), and none of Ihe exemptions were applicable 10 lhe unleased lands in the coal planning
<br />area.
