Suoh changes will dis- <br />turb the established relationsl (a) between the individual appropriators <br />downstream in Water District 67; (b) between that group and others upstream <br />in Water Distriots 14 and 17; fUld (0) between the water users in the two <br />States. To prevent suoh changes, resulting from the oonstruction and oper- <br />ation of Caddoa Reservoir, from benefiting one ditch. or one group of v.ater <br />users. or one state, to the injury of another, it becones necessary to ae- <br />fine the relations that prevailed prior to the Caddoa project, with respect <br />to the usable water supplies of the Arkansas River, and to provide against <br />material or injurious disturbances of such established pre-Ceddoa relations. <br /> <br />13. When water is impounded in Caddoa Reservoir the decreed priority <br />rights of ditches in Water District 67 are rendered ineffective as against <br />those upstream. and will not serve to apportion among the individual ditches <br />of Water District 67 the streamflow of. the district, nor serve to prevent <br />interceptions of impounded waters released for delivery at the Stateline. <br />Hence, in any plan for operating Caddoa Reservoir, a substitute program for <br />the administration of water rights in District 67 becomes necessary. Any <br />substitute administrative program must, of oourse, be acceptable to the <br />owners of said rights. for no different arrangement can be imposed without <br />their consent. Under the pInn of operation and administration herein de- <br />fined, the appropriators in Water District 67 are undertaking;. by agreement <br />among themselves a!ld with other Colorado appropriators and State officials, <br />to investigate the effects Ofl (1) limiting the total diversions in Uater <br />District 67 in an average year to substantially the total quantities divert- <br />ed in the average year of the pre-Caddoa period; and (2) dividing t he said <br />total diversions among the individual ditches of Water District 67 in ac- <br />cordanoe with average historic ratios, or such oth'.l' percent relations as <br />may be agreed upon in lieu thereof. <br /> <br />14. For purposes of defining the pre-Caddoa interstate relations, <br />with respect to the usable water supplies of the Arkansas River, it is nec- <br />essary to determinel (1) the aggregate diversions from the Arkansas River, <br />exclusive of supplies imported from other stream systems, of all irrigat- <br />ing ditches in Water Districts 14, 17 and 67 in ColoradO, including diver- <br />sions both for direct application to lands and for storage purposes; and <br />(2) the divertible and usable State line flows entering Kansas, during the <br />same period. .An attached tabulation shows the said aggregate Colorado di- <br />versions (each month, season and year of the period 1908-1942) to have <br />varied from 423,200 to 1.204,300, and to have averaged 857,200 A.F. annual- <br />ly. Names of the Colorado ditches are shol'll in a footnote on said tabula- <br />tion. They include all ditches located along and diverting from the Arkan- <br />sas River in Water Districts 17 and 67; and all in Water District 14, ex. <br />ceptl (a) the ditches supplying the Ci ty of pueblo. which are excluded <br />because their diversions are for municipal purposes a.nd do not reflect <br /> <br />(5) <br />
