In addition, the individual ditch direct flow rights of the existing <br />independent irrigations system that would participate i~ the Project were to be <br />integrated into the project and administered by the Oistrict. Also, the study <br />assumed that all project participants would share equally in the prOject water <br />supply. <br /> <br />The concept of equal sharing of project water was unacceptable to the District <br />Board and they requested that the project operation studY be modified to <br />recognize and give some advantage to those individuals holding the most senior <br />water rights and the Model land and Irrigation Company who was providing the <br />storage right.l/ <br /> <br />The Bureau modified the 1961 Operation Study and redrafted the operating prin- <br />ciples as a result of the District's concern. This modified operation study was <br />developed showing water supply available to each ditch with. Model land and <br />Irrigation Company having priority to certain storage and use of project water. <br />Resu lts of th i s study were presented in Appendi x A Supp 1 ement, revi sed Water <br />Supp 1y and Ut i1 i zat i on, Apr i1 1964, hereafter referred to as the "1964 Study." <br /> <br />Following a review by others of the 1964 Study and proposed operating prin- <br />ciples, the Bureau received a letter from the Governor of Kansas (dated December <br />3D, 1966) stating approval of the operating principles providing five additional <br />conditions were added as follows: <br /> <br />1. All inflows over establ ished Colorado water rights <br />0156.05 cfs) be designated flood flows and released as <br />promptly as downstream conditions permit. The only time <br />water so des i gnated may be stored in the conservat i on <br />pool will be when John Martin Reservoir does not have the <br />capacity to store additional water. <br /> <br />2. Any subsequent amendment of the operating principles <br />should be subject to review and approval of the ,same <br />interests as provided for in the original procedure. <br /> <br />3. Assurances that there will be no significant increase <br />in water use which would result in a depletion of water <br />yield to other Colorado and Kansas water users. <br /> <br />4. That 5 years after beginning operation of the <br />Trinidad Reservoir for irrigation purposes, the operating <br />principles be reviewed to determine the effect, if any, <br />the operation has had on other Colorado and Kansas water <br />users and the principles amended as necessary. Each 10 <br />year thereafter reviews should be provided with amend- <br />ments as needed. <br /> <br />1!In late 1966, the District contracted with one participant - Hoehne <br />Ditch Company - to deliver 95% of irrigation requirements of 1,200 <br />specified acres. <br /> <br />3 <br />
