Consultation will be completed for the construction and operation of the Animas-La <br />Plata Project by April I, 1991. Construction activities will continue while the <br />affected parties implement the recovery program in order that the federal <br />obligations under the Colorado Ute Indian Water Rights Settlement At:r. of 1986 can <br />be fulfilled in a timely fashion. <br /> <br />E. Implementation of the SJRP and all of its elements as outlined above shall satisfy <br />mitigation requirements related to Section 7 consultation for all additional <br />depletions of water from the San Juan River up to the level of New Mexico's <br />compact entitlement. <br /> <br />Further depletions from the San Juan River system in Colorado would be subject to <br />individual Section 7 consultation with the SJRP providing the means for assuring <br />successful consultation. <br /> <br />F. Nothing in this proposal shall be constrUed as affecting the obligations of the United <br />States of America to Indian tribes. Nor shall anything in this proposal be construed <br />as affecting the claims of any parry, including those asserted in any water rights <br />adjudication such as any claim by the Navajo Nation to water in excess of New <br />Mexico's compact entitlement, or as affecting the water supply available to water <br />rights of priority senior to those of the Secretary of the Interior for Navajo Reservoir <br />or their priority. <br /> <br />Submitted by: <br /> <br />State of New Mexico <br />Albert E.
