<br />(b) All losses of water <br /> <br />, <br />I <br />occurritg from or as the result of the <br /> <br />constru ted after the signing of this <br />I <br />I <br /> <br />storage of water in reservoirs <br /> <br />Compact shall be charged as follows: <br /> <br />(1) If the Commission find~ that the reservoir is used, <br />I <br />in whole or in part, to aisist the States of the Upper <br /> <br />Division in meeting thetr obligations to deliver water <br /> <br />at Lee Ferry imposed by Article III of the Colorado <br /> <br />River Compact, the co.t. ission shall make findings, <br /> <br />which in no event shalt re contrary to the laws of the <br /> <br />United States of Americ,," under which any reservoir <br />, <br />, <br />I <br />is constructed, as to th~ reservoir capacity allocated <br /> <br />for that purpose, The thOle or that proportion, as the <br /> <br />case may be, of reservrir losses as found by the <br /> <br />Commission to be reasbnably and properly charge- <br />I <br /> <br />able to the reservoir ot reservoir capacity utilized <br /> <br />] <br />, <br />to assure deliveries at Lee Ferry shall be charged to <br /> <br />the States of the Upper Division in the proportion which <br /> <br />, <br />the consumptive use ofl water in each State of the Upper <br />! <br /> <br /> <br />Division during the water year in which the charge is <br />! <br />I <br />made bears to the totar consumptive use of water in all <br /> <br />States of t~e Upper Dirision during the same wat~r year. <br /> <br />Water stored in reser, oirs or in reservoir capacity <br />, <br />! <br />covered by this subpa~agraph (b) (1) shall be for the <br />i <br /> <br />common benefit of all of the States of the Upper Divi- <br /> <br />sion. <br /> <br />-8- ! <br />
