<br />'. <br /> <br />-7- <br /> <br />sion could only resort to appropriate courts in the <br />United States for enforcement. <br /> <br />(11) The United States Section of the Com- <br />mission has jurisdiction only over such works within <br />the interior of the United States as are used exclu- <br />sively for the performance of Treaty functions. <br /> <br />(12) Adequate control over the United States <br />Section of the Commission is afforded by (a) the <br />fact that the com position and tenure of the person- <br />nel are subject to Congressional action, (b) funds <br />to support the Section and to construct, operate, <br />and maintain works must be provided by Congress, <br />and (c) recommendations and decisions are subject <br />to approval by the Department of State. <br /> <br />(13) The United States Section has no author- <br />ity to exercise any judicial functions and cannot de- <br />termine private rights. <br /> <br />A copy of the Treaty is appended hereto. The <br />provisions of the Treaty are themselves the best <br />proof of the assertions made in this memorandum. <br /> <br />PRELIMINARY STATEMENT <br /> <br />'The international streams of the southwest, the <br />Rio Grande, and the Colorado and Tijuana Rivers, <br />have long presented a serious problem to those con- <br />cerned with the development of the areas through <br />which they flow. This arises from the uncertainty <br />of the extent of the right of Mexico to receive a por- <br />tion of the waters of these river systems. Until <br />the extent of the Mexican right is defined, there is <br />no basis for any worthwhile determination of the <br />amount of water available for use in the United <br />States. <br />
