So far as international <br />disputes are concerned in connection with the inter- <br />pretation, construction, and administration of the <br />treaty, the Couunission would not be usurping the <br />functions of the judicial branch of the United States <br />Government or of any existing international judicial <br />. tribunal. <br /> <br />JURISDIC'l'lOK AND POWERS OF THE <br />UNITED STATES SECTION <br /> <br />In discussing the jurisdiction and powers of the <br />United States Section, the same classifications will <br />be followed as were used in the discussion in the <br />jurisdiction and powers of the Commission. <br /> <br />(A) POWERS PERTAINING TO WORKS <br /> <br />Much of what has been said with respect to the <br />powers of the Commission is applicable here. Most <br />of the works which are to be constructed are specifi- <br />cally enumerated in the Treaty. Those which are <br />not specifically enumerated but which are to await <br />further investigation and study are narrowly cir- <br />cumscribed. Those on the Rio Grande are confined <br />almost entirely to the main stream. No works on the <br />United States tributaries of the Rio Grande are <br />provided for. On the Colorado, the only works the <br />construction of which are not specifically covered by <br />the Treaty but which may be built under the terms <br />of the Treaty are flood control works below Imperial <br />Dam. With respect to all the works which are left <br />for future determination, two effective checks are <br />provided: first, the necessity for approval of the <br />two Governments; and, second, the necessity for <br />Congressional appropriation. <br />
