The Interstate Stream Commission has not received from Reclamation advanced <br />copies of the Attachments to Volume I of the DElS and of Volume II of the DElS, with the <br />exception of the Draft Biological Assessment. The documents to be provided in Volume II are of <br />critical importance to support the findings and conclusions of the DElS, and the cooperating agencies <br />should have the opportunity to review them before they are maue avaiiau]" 1U1 ,,,vi,,,,, by the general <br />public. In particular, the State of New Mexico agencies (the Interstate Stream Commission, the <br />Game and Fish Depanment, and the Environment Department) have a keen interest in reviewing the <br />technical background material on hydrology and water quality and the fish and wildlife <br />documentation, such as the trout health assessment. The impacts of modified Navajo Dam <br />operations occur largely to New Mexico and its people, and the State agencies are conscious to see <br />that all impacts are reliably assessed in the DElS. The Commission again requests an opportunity <br />to review and provide comment on the Volume II materials in full before the DEIS is issued for <br />public review and comment. <br /> <br />CHAPTER n <br /> <br />Lines 26-27. Delete line 26 in its entirety; and on line 27, replace "enable future" with "and to <br />enable". The lines as written incorrectly relegate the development and use of compact <br />apportionments to something other than an authorized purpose of the Navajo Unit. <br /> <br />Line 28. Replace "court" with "Supreme Court". The suggested language is consistent with the <br />goals of the SJRBRIP. <br /> <br />Line 33. Add a paragraph that reads: "The Flow Recommendations criteria are not necessarily <br />inviolate, and progress towards recovery of the endangered fish species in the San Juan River will <br />be measured by all actions taken to improve endangered fish habitat and population status, as well <br />as by population response, consistent with the recovery goals for the species and the SJRBRIP's <br />Principles for Conducting Endangered Species Act Section 7 Consultations on Water Development <br />and Water Management Activities Affecting Endangered Fish Species in the San Juan River Basin. <br />Reasonable alternatives to operating Navajo Dam to meet fully the criteria of the Flow <br />Recommendations may be considered. Further, the SJRBRIP is to provide reasonable and prudent <br />alternatives to allow further water development to take place in the San Juan River Basin in <br />accordance with interstate compacts and Federal trust responsibilities to Indian tribes in the Basin <br />and in compliance with the ESA." <br /> <br />Line 46.
