,

February 13, 1998
Page 4

1401

.

Non-Irrigation Season Stock Water Allowance

The current Operating Principles provide an allowance for non-irrigation season stock water purposes
of "not more than five second feet or its volume equivalent", The 1996 Bureau Report states that
since initial operation of the Project, the Purgatoire District has made the stock water releases at higher
rates of flow for a short duration oftime for more efficient filling of stock water ponds.

The proposed amendments to Article IV - ,o.2(a) would eliminate the 5 cfs flow rate limit, and allow
releases up to 1,200 acre-feet per season at a rate up to but not exceeding the daily rate of reservoir
inflow. We agree that it likely is more efficient for the Purgatoire District to make stock water
releases at higher flow rates of shorter duration, and do not see any reason why downstream Colorado
water users should be concerned about this amendment.

We appreciate the opportunity to assist you in this matter. Because the time available for our review
of the proposed amendments was relatively short, it may be possible that we will identify additional
issues after giving these matters more thought and receiving comments from water users. However,
we believe that the issues identified above are those of primary concern to the District 67 Ditches and
Fort Lyon Canal Company, Please call if you have any questions or need additional information.

Sincerely,

· -;g~t K~

Bruce E.
