Weiss, Esq. <br />First Assistant Attorney General <br />Natural Resources Section <br />1525 Sherman Street, 5th Floor <br />Denver, CO 80203 <br /> <br />Colorado Water <br />Conservation Board <br /> <br />Re: Trinidad Project Operating Principles <br /> <br />Dear Wendy: <br /> <br />When I was at the Arkansas River Basin Water Forum on Wednesday, Tom Pointon <br />told me that he had met with Bob Buerkle, the Kansas ARCA representative, and gave me <br />a memorandum addressed to Jack (Garner, I assume) (enclosed) of changes to the Trinidad <br />Project Operating Principles which Tom said that the Fort Lyon Canal Company and the <br />Kansas representatives would like to see. <br /> <br />I told Tom that I would look over the memo, but that you were handling the <br />. proposed changes to the Operating Principles and that I would pass his memo along to you. <br /> <br />I didn't have an opportunity to ask Tom what the -proposed change to Article I <br />means. Currently, water stored under the Model Storage Right and carried over to the next <br />year does count against the one-fill of the Model Storage Right in the following year. The <br />change the Purgatoire District wants to make as I understand it is to separately account for <br />water stored during the winter as water stored under the priorities of the direct-flow rights <br />of the Project ditches rather than charge that water against the Model Storage Right. As <br />I understand the PRWCD's proposed changes, water stored under the Model Storage Right <br />and carried over to the following year would still count against the one-fill in the following <br />year, so I'm not clear what Tom intends. <br /> <br />Very truly yours, <br /> <br />~ <br /> <br />Dennis M.
