Under PL 92- <br /> <br />500 the objective of eliminating the discharge of pollutants is a "national <br /> <br />goal extending to navigable waters. ,,21 The mainstream of the Colorado <br /> <br />is navigable as a legal matter, 22 as are its tributaries which affect its <br /> <br />navigable capacity.23 Also, in-stream standards for ambient receiving <br /> <br />water ("water quality standards") existed for the interstate and intra- <br /> <br />state surface waters within the CRB before PL 92-500, as a result of <br /> <br />the Water Quality Act of 1965.24 Those standards, except as revised, <br /> <br />25 <br />continue to cover the Colorado River system under PL 92-500.' No <br /> <br />direct legal precedent is known at this time which would exclude stret- <br /> <br />ches of surface water on federal reserved lands and Indian reservations <br /> <br />from existing and planned water quality standards. <br /> <br />Applicability to State and Federal Lands and Facilities. The Act <br /> <br />encompasses state and federal lands through two provisions: <br /> <br />Area wide and basin planning. Public lands are not expressly <br /> <br />exempted from areas subject to area wide waste treatment planning un- <br />26 <br />der PL 92 -500, and thus both federally owned and state owned lands <br /> <br />appear to quality for inclusion in such plans. Public lands are also <br /> <br />implicitly subject to Level B basin planning, under the Water Resources <br /> <br />27 <br />Planning Act of 1965, which is perpetuated by PL 92-500. <br /> <br />Effluent limitations and discharge permits. To control and phase <br /> <br />out the discharge of pollutants, PL 92-500 requires that all point-source <br /> <br />5 <br />
