<br />The nature of the resale article, and an <br />explanation of the history underlying its <br />development, is succinctly summarized in a 1967 <br />letter from the Department of the Interior's <br />Assistant Solicitor, Power to the City Attorney of <br />Redwood Falls, Minnesota. The letter harmonizes <br />the resale principle with the practical <br />difficulties of administration: <br /> <br />Although the principle is clear in concept, <br />experience has proven that the administration <br />of this principle in Federal power marketing <br />operations presents many practical <br />difficulties of interpretation and <br />application. The phrases "fair and <br />reasonable terms" and "sound business <br />principles" are general at best and give rise <br />to many different interpretations among <br />reasonable men as to their precise <br />application. It is for this reason that the <br />article itself does not set forth any <br />specific mechanisms for enforcement. The <br />only specific implementing provisions in the <br />remaining paragraphs are reporting <br />requirements. These are designed to give not <br />only this Department, but more importantly <br /> <br />71 <br />
