Endangered Fisb Recovery, cont) The contract and E1S sbould <br />clearly state the relationship between the flows provided for endangered fisb as a result of the current <br />negotiations and any past agreements. Mitigation of tbe Dolores and Dallas Creek Projects included <br />agreements by the Bureau of Reclamation to make releases totalling 148,000 acre-feet (annually?) from <br />the Aspinall Unit for the benefit of endangered fisb. These releases should be: (a) specifically <br />accounted for in the contract and (b) included in the discussion of environmental impacts and <br />assessment of water supply in the E1S. <br /> <br />lb. NONFED75; p2,'1. 2) Additional WHEREAS clauses are needed [pREAMBLE] to properly <br />defme the nature of the conditions placed on Aspinall Unit operations by the water right decrees in <br />effect for the Aspinall Unit, the assignment of those water rights to the United States from the CRWCD <br />in 1963, the agreement under whicb 60,000 acre-feet of upstream depletions are anticipated by post- <br />Aspinall Projects upstream from Crystal Dam, and the interests of all the parties to the 1975 Excbanage <br />Agreement. <br /> <br />lb. <br /> <br />NONFED75; p2, '3-6. 3) We do not agree, nor do we consent to the designation of 300,000 <br />acre-feet as the amount whicb is "available for beneficial consumptive use within the State of Colorado" <br />[, 5.c. and 5. f.] <br />a) We are not aware of any study by Reclamation which substantiates a project. <br />yield of 300,000 acre-feet as available for development. <br />b) It is our understanding that 60,000 acre-feet is available for depletion by <br />present and future in-basin users upstream from the Aspinall Unit, and that 60,000 acre-feet is <br />not part of the Aspinall Unit yield, nor is it storable under the Aspinall Unit decrees. <br />c) We do not agree that part of the Aspinall Unit yield is available for use <br />anywhere in Colorado. Under the terms of the Aspinall Unit decrees and tbe assignment of <br />tbose decrees to the United States, use of Aspinall Unit water must be made within the natural <br />basin of the Gunnison River. <br /> <br />. ;,~:"'.!... <br />;:::~,;~;;!;'; <br /> <br />lb.
