The Hoehne Ditch Company had historically diverted 200 to 300 acre <br /> <br /> <br />feet during the nonirrigating season for stockwater purposes. Therefore, the volumetric limit for <br /> <br /> <br />stock water releases should be reduced to 1200 to 1300 acre feet, including the river gains from <br /> <br /> <br />Trinidad Dam to the Trinidad gauge during the non-irrigation season. <br /> <br /> <br />The operating principles should be modified to clarifY Project operations for stock water <br /> <br /> <br />releases during the non-irrigation season and to reduce the total stock water allowance in <br /> <br /> <br />accordance with the Court-ordered termination of the Hoehne Ditch Company's'stock water <br /> <br /> <br />diversion rights during the non-irrigation season. The operating principles should only be changed <br /> <br /> <br />so that the equivalent volume of 5.0 cfs as measured at the Trinidad gauge inclusive of river gains <br /> <br /> <br />from Trinidad Dam should be reduced to 4.0 cfs or an equivalent volume of 1200 acre feet to <br /> <br /> <br />account for the termination of the Hoehne Ditch Company's right to divert stock water during the <br /> <br />non-irrigation season. <br /> <br />3. lrrigable Lands <br /> <br /> <br />The operating principles limit the Project irrigated acreage to 19717 acres of class 1, .2 <br /> <br /> <br />and 3 lands. As reported in the 1988 review of operating principles report, the total irrigated <br /> <br /> <br />acreage of 19717 acres had not been exceeded but the district was technically in violation of the <br /> <br /> <br />operating principles because lands other than class 1, 2, and 3 were being irrigated. The <br /> <br /> <br />Reclamation Reform Act of 1982 exempted COI1JS projects from Reclamation Law. Since land <br /> <br /> <br />classification is a requirement of Reclamation Law, the 1982 Act eliminated land classification <br /> <br /> <br />requirements of the Trinidad Project. The 1986 amendment of the contract between Reclamation <br /> <br /> <br />and the District deleted this requirement; however, the operating principles have not been <br /> <br />amended to delete land classification requirements. The District is presently irrigating lands other <br /> <br />19 <br />
