The <br /> <br />Company has been diverting an average of approximately <br /> <br />35,000 acre-feet from the Roaring Fork River, but its <br /> <br /> <br />rights would permit a tatal of about 53,000 acre-feet. <br /> <br /> <br />The full amount is not diverted because of lack of <br /> <br />storage capacity on the East Slope to regulate and make it <br /> <br /> <br />available. By diverting water from South Fork of Hunter <br /> <br /> <br />Creek rather than from the Roaring Fork there will be <br /> <br /> <br />benefits to fish and wild life in the latter stream. <br /> <br />Effect of Diversion on Colorado River Flows <br />Within Colorado <br /> <br />The Colorado Water Conservancy Act requires that in <br /> <br />case of transmountain diversions built by any district <br /> <br /> <br />created under the Act.':1e"... works or facilities shall be <br /> <br />designed, constructed and operated in such a manner that <br />the present appropriations of water, and in addition <br />thereto, prospective uses of water for irrigation and <br />other beneficial consumptive-use purposes, including <br /> <br />consumptive uses for domestic, mining and industrial <br /> <br />purposes, within the natural basin of the Colorado River <br /> <br />in the State of Colorado, from which the water is exported <br />will not be impaired nor increased in cost at the expense <br />of the water users within said natural basin; and that <br /> <br />the facilities and other means for the accomplishment of <br /> <br />said purpose shall be incorporated in, and made a part <br /> <br /> <br />of, any project plans for the exportation of water from <br /> <br />said natural basin in Colorado." <br />
