<br /> <br />42 <br /> <br />CqLORADO RIVER STORAGE PROJEOT <br /> <br />regulation No.1, relative to reimbursement of the Upper Oolorado <br />River Basin fund from eharges for electrical energy to be made at the <br />Hoover powerplant subsequent to June 1, 1987, would not appear to <br />be anthorized by existing law, but rather to be in conflict therewith. <br />Section 5 of the Boulder Oanyon Proj ect Act, to which reference is <br />made in said article 5, does not authorize sueh regulation. This <br />section in part reads as follows. <br />Mter the repaymen:ts to the United States'of all money advauQed with interest' <br />charges shall be on 8\1oh basis and the revenues derived therefrom shall be kept <br />in a separate fund to ibe. expended within the Colorado River Basin as may here~ <br />after be prescribed by the Congress. <br />The Oongress has not taken action up to the present time in this <br />regard excepting in the Boulder Oanyon Project Adjustment Act. <br />Section 2 of the Adi'ustment Act provides in part that all receipts <br />from the projeet shal be paid into the Oolorado River Dam fund and <br />shall be available for the particular matters therein specified, none of <br />which includes reimbursement of the Upper Oolorado River Basin <br />fund. In addition, section 7 of the act of April 11, 1956, providing <br />for the Oolorado 'River storage project and participating projects <br />provides in part that "in the exercise of the authority hereby granted <br />he [the Secretary] ,shall not affect or interfere with the operation of <br />the provisions of the Oolorado River compact, the Upper Oolorado <br />River Basin compact, the Boulder Oanyon Projeet Act, the Boulder <br />Oanyon Project Adjustment Act, and any contract lawIUlly entered <br />into under said compacts and acts." <br />Respectfully submitted. <br /> <br />JAMES F.
