7. Land Acquisition: D:Jes this section irrply that the land not used for the
test well would be transferred to B[M after installation of pennanent
facilities (well site, pipeline, road, powerline, warehouse)? We would prefer
transfer of the land, transfer of administration of the land immediately by B[M
under the a:R/B[M I1\'lster MJU. ApparentlYt OCIR has purchased more than 360 acres
near Bedrock. Discuss and show these lands on the I1\'lps.

Response:

As agreed to in a memorandum of March 25, 1985, to the B[M, this section has
been expanded to indicate that, on completion, any land unnecessary for unit
purposes would most likely be transferred to the B[M for administration. As
stated in the assessment, ReclaI1\'ltion holds fee title to approximately 452 acres
of land. ReclaI1\'ltion sees no relevance in displaying this ownership in the
assessment.

15. Canrent:

8. Page 28 - pennits: D:Jes the Colorado State Highway Cepartment need to per-
mit the utility crossing at C-90 and proposed road irrprovem:nts at C-90
(intersections, grades, etc.)? Are the county, and Corps of Engineers up to
date on the proposed actions? Are any other pennits needed for the project?
See canrent No. 1 above in this section.

Response :

The pennit section of the assessment has been expanded. The State Highway
Department does require crossing pennits, which ReclaI1\'ltion has obtained.
Reclamation has coordinated with the county and the Corps of Engineers on the
unit and has applied for a right-of-way across B[M administered land.

16. Cannent:

1. Sodium lease D-046504 issued 11/1/1934 to Union Carbide Corporation ({ME'lO))
and renewed in 1985, is on public lands adjacent to the project area. How would
\METCO's sodium lease rights be protected? Would the brine underlying the
Federal lease be drained by BCR's pumping of the brine field?

Response:

ReclaI1\'ltion is not taking any steps to protect lMEI'CO's sodiun lease rights
since the test would have no effect on their operation. In the future, if the
demmd for additional brine exists, ReclaI1\'ltion would be a willing provider.

17. Canrent:

2. More discussion is needed on the existing geology and minerals, such as
brine concentrations and the potential for other minerals (such as oil and gas)
in the fonnations being drilled. If oil and/or gas is encountered in the
injection well, what actions would be taken to ensure it would not be lost?

Response:

28

on

10
