The Western States \'later Council believes that if an <br />appropriate set of reccmrerrlations are fo:rwarded to the President that <br />can be based on a reasonable legal stan:1ing by federal attorneys, that <br />the rrechanism of formalizing the Administration's policy executive order <br />would be useful,as the Task Force has =ncluCled. <br /> <br />As previously stated, however, the \'lesten1 States Water Council <br />feels that further =nsideration should be given to going beyoni an <br />executive order, and in certain areas, seeking legislation to clarify <br />. c-., issues, including the establishnent of federal reserved rights in <br />the future. If the Task Force reccmrendations are to flo\v out of the <br />Interior Department's Solicitor's opinion and alleges new federal \vater <br />rights such as the non-reserved water rights d=trine expoused, the <br />Council will be opposed to any formalization of the Task Force recan- <br />mendations. <br /> <br />.... <br /> <br />Further, the western states see little value in the Task Force <br />report unless all federal participants are to be round by the decisions <br />made. The Western States Water Council has sensed a certain al=fness <br />in the Justice Dept. with respect to the entire exercise.
