<br />FRYING PAN-ARKANSAS PROJECT.

<br />supply works involved in the Fryingpan-Arkansas project shall be constructed
<br />by the Secretary in the absence of evidence satisfJ.ctory to him that it would be
<br />infeasible for the communities involved to construct the works themsel....es) singly
<br />or jointly. In the event it is determined that these works, or' any of them, are to
<br />be constructed by the Secretary) a contract providing) among other things, for
<br />payment of the actual cost thereof, with interest as hereinafter pro....ided, as
<br />rapidly as is consistent with the contracting parties' ability to pay, but in any
<br />event, within fifty years from the time the works are first available for the delivery
<br />of water, and for asswnption by the contracting parties of the care, operation,
<br />maintenance, and replacement of the works shall be a condition precedent to

<br />Sec. 2. [Repayment period for irrigation water userSj no development period
<br />authorized-Rates to be charged for commercial power and water for munici-
<br />pal, domestic or industrial use-Interest rates.]-(a) Contracts to repay the
<br />portion of the' cost of the Fryingpan-Arkansas project allocated to irrigation and
<br />assigned to be repaid by irrigation water users (exclusive of such portion of sJ.id
<br />cost as may be derived from te.mporary water supply contract.5 or from other
<br />sources) which are entered into pursuant to subsection (d), section 9, or the
<br />Reclamation Project Act of 1939 (53 Stat. 1187), as =ended, sholl prm.ide ~or
<br />a ba...<;ic rcp3.yment period of not more than fifty years after completio!l of con-
<br />struction and shaH not provide for any development per:od. Such co::tr.lC~S s~::!.iI

<br />(b) Rates charged for commercial power and for water for rr.uniciDal,
<br />domestic or industrial- use or for the use of facilities for the storage anl/or
<br />delivery of such water shall be de~igned to return to the United Sta~es, v,.-it~in
<br />not more th<!.n fifty ye.:-,rs from the completion of each unit of the project which
<br />serves those purposes, those costs of constructing) o?erating and maintaining that
<br />unit which are allocated to said purposes and interest ~n the unJ.mortized
<br />balance of-said 'construction allocation and, in addition, within the period fixed
<br />by subsection:( a) of thIs-section, so much of the irrigation allocation as is beyond
<br />the ability of the water users and their organizations to repay.
<br />(c) The interest rate on the unamortized balance of the commercial power
<br />and municipal, domestic, and industrial water supply allocations shall be deter-
<br />mined by the Secretary of the Treas'ury, as of the beginning of the fiscal year in
<br />which construction is initiated, on the basis of the computed a...-er:1ge interest rate
<br />payable by the Treasury upon its outstanding marketable public obligations,
<br />which are neither due nor callable for redemption for fifteen yeJ.rs from the da.te'

<br />Sec. 3. [Operating principles--Benefits and rights of western Colorado water
<br />users-Interbasin .transfers .of water.J-(a) The Fryingpan-Arkansas project
<br />shall be operated under the' directio.n of the. Secretary in accordance with the
<br />operating principles adopted by the. State of Colorado on December 9, 1960,.
