AlIottees of the District <br />would continue to use their share of the Colorado-Big Thompson Project yield without <br />involvement by Reclamation, The public aspects of the project would be protected. <br /> <br />No Action Alternative <br /> <br />If the title to the selected water facilities were retained by the United States, there <br /> <br /> <br />would be no change in water quality or existing water rights appropriations or allocations. <br /> <br />AlIottees of the District would continue to use their share of the C-BT Project yield <br /> <br />without involvement by Reclamation. <br /> <br />Wetlands aod Waters of tbe U.S. <br />The facilities included in the proposed title transfer have waters of the U.S. and <br />wetlands within their associated easements. The following intermittent drainages are <br />crossed by the canals included in the facilities proposed for transfer: Empire Gulch, Long <br />Gulch, Rist Canyon, Log Canyon, Park Creek, and several other unnamed tributaries. <br />Each of these intermittent drainages with a defined bed and bank is a water of the U.S. In <br />addition, portions of two perennial drainages, Lewstone Creek and the Cache la Poudre <br />River and their associated wetlands, are within the easements associated with the <br />facilities proposed for title transfer. The discharge of fill and dredge material into waters <br />of the U.S., including wetlands, is regulated by the U.S. Army Corps of Engineers <br />(Corps) under Section 404 of the Clean Water Act (CW A). Depending on its location <br />and the activity, the maintenance, rehabilitation, and repair of the facilities proposed for <br />title transfer could require the discharge of dredge or fill material into waters or wetlands. <br /> <br />The canals themselves, and the wetland vegetation directly adjacent to the canals, are <br /> <br />not considered subject to jurisdiction by the Corps under Section 404 of the CW A and <br /> <br />15 <br />
