No. 247 I Thursday, December 22. 1983 f Notices <br /> <br />Policy <br /> <br />The operating policy for Green. <br />Mountain Reservoir is set forth in the <br />nine policy statements that follow. <br />1. Green Mountain Reservoir has e <br />total storage capaclty of 153.639 acre- <br />feet of water. Of that total capacity. <br />52.000 acre-feet are available to provide <br />replacement water in welKern Colorado <br />when water is diverted to the eastern <br />slope through the CBT Project. The yield <br />from remaining capacity [commonly <br />referred to as the 100.000 acre-foot <br />power pool]. including the refill right. <br />will to the extent feasible be released <br />through the powerplant. and the water <br />so released shall be available for other <br />beneficial consumptive uses in western <br />Colorado as hereinafter set.out <br />2. Water will be released from Green <br />Mountain Reservoir for westem <br />Colorado use from the 52,000 acre-foot <br />CBT replacement pool to the extent <br />necessary to replace CBT diversions <br />which would otherwise be <:urtailed by a <br />legal call on the river. When the <br />administration of water under the <br />priority system established by the laws <br />of the State of Colorado would result in <br />curtailment in whole or in part oI a <br />water right for inigation or domestic <br />uses [as hereinafter defIDed] within <br />western Colorado. which was perfected <br />by use on or before October 15. 1977, <br />and the water need is not met by the_ <br />foregoing, water will be released <br />without charge from Green Mountain <br />Reservior from the 100.000 acre-foot . <br />power pool to the extent necessary to <br />pefDlit diversions to the full amount of <br />said decrees; Provided. however. That <br />releases from the power pool for these <br />purposes shall not exceed 66.000 acre- <br />feet of water per annum [measured at <br />Green Mountain Dam}. which quantity <br />shall be deemed adequate to satisfy all <br />such so perfected uses with a priority <br />date senior to October 10, 1977. All such <br />releases made pursuant to this <br />paragraph shall be administered by the <br />Slate Engineer under the priority system. <br />3. The releases required by paragraph <br />2 above shall be made within a 12- <br />month period following the date fIXed by <br />the Secretary of Interior in accordance <br />_ with pararaph 4(aJ in the 1955 <br />Stipulation in the Consolidated Cases. <br />4. When water is released for <br />purposes other than those specified in <br />paragraph 2 to meet certain western <br />Colorado users' needs rather than for <br />power generation at Green Mountain <br />Powerplant.[although power may be <br />gene,ated with such releases}. an <br />agreement will be required between the <br />user and the Regional Director. LMR. <br />Water service charges. including power <br />interference charges when appropriate. <br /> <br />relative to such agreements will qe <br />established by the Regional Director. <br />LMR. after consultation with the <br />Regional Director. UCR. <br />5. Dirrerential water service charges <br />will be charged for water released for <br />domestic. inigallon (charges-ror <br />domestic and inigation uses shall be <br />nominal). and industrial purposes. For <br />the purposes of this operating policy. the <br />following definition of the uses of water <br />will apply. <br />a. Domestic Use-The use of water by <br />-individuals. cities, towns. public or <br />quasi-public districts. private <br />corporations. homeowners' associations. <br />or other entities for domestic. municipal. <br />and miscellaneous related purposes as <br />those terms are traditionally and <br />commonly construed. excepting only the <br />irrigation and industrial uses of water as <br />defined below. <br />h.lrrigatian Use-The use of water <br />for the commercial production of <br />agricultural crops and livestock and <br />other uses consistent with any water. <br />right decreed for irrigation purpose.. <br />- c.lndustrial Use-The use of water <br />for purposes of producing or processing <br />a nonagricultural product or service for <br />sale. including without limitation such . <br />uses as manufacturing, mining, milling. <br />land reclamation. snowmaking. and <br />nonhydroelectric power generation. <br />To the extent water is diverted by an <br />individual. corporation. or otlJer enllty <br />for uses heretofore described in 5 (a) <br />and (b). such uses shall,be so classified <br />for water service charge purposes. All <br />other uses by such an individual. <br />corporation or entity. even if such use <br />predates October 10. 1977, shall be. <br />subject to the requirements of paragrl!ph <br />4 hereof. <br />o. Agreements as described in <br />paragraph 4 with the water service <br />charge based on the use as described in <br />paragraph 5 may be consummated with <br />water users in the geographic area of the <br />Colorado River Basin. The water may be <br />used in accordance with Colorado State <br />law directly. hy exchange. or by <br />augmentation of water development to <br />enable water to be benefically used in <br />western Colorado. Any agreements for <br />such use and any agreements provided <br />for in paragraph 8 hereof shall be <br />referred to the State Engineer for review <br />as to administration feasibility prior to <br />execution. Such water service <br />agreements shall be provided to the <br />Division Engineer of the State of <br />- Colorado for administration of releases <br />and deliveries. <br />7. Upon request by the Division <br />Engineer _of the State of Colorado, the <br />Bureau shall release water from the <br />100,000 acre-foot power pool: First, to <br />satisfy the needs of users pursuant to <br /> <br />paragraph 2 and second. to satisfy the <br />contract needs of users pursuant to . <br />paragraph 4. The Bureau, based upon <br />water supply information developed <br />pursuant to the Stipulation. Judgment. <br />and Decrees in the Consolidated Cases. <br />will take reasonable and prudent <br />actions to insure that water released <br />pursuant to paragraph 4 does not impair <br />or diminish the availability of water for <br />release pursuant to paragraph 2 hereof. <br />8. In order that no waste of water <br />results from the unnecessary storage <br />thereof and in order to maximize the <br />beneficial use of water stored in Green <br />Mountain Reservoir. the Regional . <br />Director. LMR. on a yearly basis <br />between April 1 and May 15 will <br />determine the anticipated ~mount and <br />uses of stored water reasonably <br />necessary to meet the objectives of <br />paragraphs 2 and 4 hereof. Any stored <br />water in excess thereof may be disposed <br />of on a short-term basis by agreement as <br />provided in paragraphs 4 and il hereof. <br />9. Revenues resulting from any <br />agreements provided for herein will be <br />credited to the operation and <br />maintenance costs of'Green Mountain <br />Dam and Reservoir. to power <br />. replacement. and to appropriate project <br />costs. _ <br /> <br />.
