The legis- <br />lation requires that the tribal water rights be used as state <br />water rights aff-reservation and prohibits the sale or lease of <br />waters from ALP or the Dolores Project into the lower basin, ab- <br />sent an agreement of those states taking water from the Colorado <br />River ar a court decision which halds that the sale of state <br />water rights is permitted by the law of the river. <br />The last piece of necessary federal legislation is the <br />appropriation of the third and final federal contribution to the <br />tribal development fund, which is expected to occur this year. <br /> <br />B. State Legislation <br /> <br />The necessary state legislation included appropriations <br />for: (1) construction of a drinking water pipeline to Towaoc, <br />Colorado; (2) state contributions to the construction of the ALP; <br />and (3) state contributions to the tribal development fund. All <br />of these state appropriations have been made. <br /> <br />V. Final Consent Decrees <br /> <br />The parties are in the process of distributing and signing <br />the stipulations for consent decrees. One stipulation, the San <br />Juan River stipulation, has already been filed. After these <br />stipulations are filed with the court, hearings on the proposed <br /> <br />-12- <br />
