"

,

"I was attempting to. trace what might happen if a court af
international arbitration shauld decide that Mexico was entitled
to. water of usable quality. I was abaut to state that a caurt
would be justified in saying that the United States agreed to.
give Mexico 1,700,000 acre-feet of usable water and that it
had to be equal to. the quality af the water in Lake Mead at the
time the treaty was made. What that would lead us to I do not
knaw, but it wauld perhaps lead us to. a millian or two millian
mare acre-feet af water than this treaty purparts to give because
we are asked to give a guaranteed right which might lead us into.
reparatians and damages to. the extent of huge amaunts."

Senatar Millikin lead the propanents of this treaty an the floor af the

Senate, at least so far as the Colorado River was concerned. On page 2821

Senator Millikin painted out that the treaty provided that the water is to came

from any saurce. Also. there is a provision that same af the water is to be

delivered'via the All-American Canal which will be Lake Mead water. This

water will cantain anly that amount of salts resulting from Upper Basin use.

It is Senatar Millikin's posltian at this paint that Mexico. can nat expect

better water than "we aurselves use". The Senator cantinues:

"That 500,000 acre-feet carries the same salinity that it will
__havjU~.f.!~~ finish wi!..h-Uln the ~()per basin. The r~st.9ithe________
water as delivered in the limitrophe section of the stream--I
shall develap that paint a little later--that water, fram its very
nature, will carry whatever salt it has in it when it reaches
that section of the stream.
"The provisians of the treaty which draw the distinctian
between the water which will be delivered fram Lake Mead and
the water which will be delivered in the limitrophe section af
the stream show conclusively that Mexico knew exactly what
she would get insofar as the quality af the water is cancerned."
(p. 2821)

Senator Dawney at this point interrupted to insist that there is nathing

in the treaty which prevents the All-American Canal delivery from also. being

B 33
