In an agreement as a result of a River District <br />lawsuit, Northern Colorado Water Conservancy District agret'd <br />to build a compensatory dam and reservoir on the West Slope as <br />mitigation for their Windy Gap diversion near Granby. That was <br />to be Azure Reservoir on the Colorado River west of Kremmling. <br />Studies revealed that Azure was indeed an excellent project, but <br />others might be even better and less costly. <br />There followed months of intense negotiations resulting in a <br />supplementary agreement, the bottom line being that Northern <br />Colorado would make a payment of $10.2 million to the Colorado <br />River District freeing Northern of any further obligation and the <br />District would then build its own project. <br />This settlement provided the financial basis for the River <br />District to undertake construction of a storage facility as mitiga- <br />tion for the Windy Gap Project. In April of 1985. the District sub- <br />mitted an application to the U.S. Forest Service for the construc- <br />tion of Rock Creek Reservoir in Routt National Forest abov~ Mc- <br />Coy with an alternate site. Muddy Creek north of Kremmling. <br />Studies had not been completed nor site selt'ction madt. by <br />Federal ag~ncies by the end of 1987. <br />Any dam and reservoir that is identified as approved and ac. <br />ceptable after local. state and rederal requirements have been <br />met will provide storage for Western Colorado water users today <br />and meet some of the anticipated demands for water in the <br />future. <br />As part of a Memorandum of Understanding. Denver has <br />agreed to lease. for a limited time, most of the storaRe to meet <br />their short term water needs. The lease of water from the project <br />will provide funds to help finance other projects in Western Col. <br />orado as they are needed.
