<br />. <br /> <br />. <br /> <br />Agenda Item 11 <br />August 10. 1990 <br /> <br />bill a convenient vehicle to carry the Reclamation Reform Act <br />and double subsidy amendments. <br /> <br />Title I provides for a ceiling increase for CUP of <br />$679.854.537 and stipulates the terms of construction for <br />project completion. The major provisions of this title are: <br /> <br />(1) Cost-sharing of irrigation features is 35 percent for <br />construction and 50 percent for required studies. <br /> <br />(2) All construction is to be done by the Central Utah <br />Water Conservancy District under the provisions of the Drainage <br />and Minor Construction Act. <br /> <br />(3) Construction must be completed within 5 years after <br />required studies are completed or else authorization is <br />rescinded. However. $125 million would remain available for <br />alternative features. <br /> <br />(4) Construction in the Uinta Basin. amounting to $30 <br />million. is not cost shared. <br /> <br />(5) Grants are available. totalling $40 million. for 65 <br />percent Federal cost sharing of local municipal and rural water <br />systems. <br /> <br />Title II would establish a Mitigation and Conservation <br />Commission that would manage the fish. wildlife. and <br />recreational authorization of the act. The Commission would be <br />responsible for $10B.6 million of authorized funds. It would <br />operate 20 years. after which its functions would transfer to <br />the Utah Division of Wildlife. <br /> <br />As a companion to Title II. Title III would establish a <br />"mitigation and conservation account" to provide additional <br />funds. Authorized funds in this title amount to $40 million. <br />with certain CRSP power receipts being diverted to the fund in <br />perpetuity. but only after they are first credited to the Upper <br />Colorado River Basin Fund. This amounts to a continuous annual <br />appropriation without yearly action by Congress. <br /> <br />Title IV addresses the Ute Indian water rights settlement. <br />Credits are given for undeveloped water rights in the form of <br />diverted M&I receipts over a period of 50 years. totalling $85 <br />million. These credits do not count against ceiling. An <br />additional $195 million is provided in authorized expenditures. <br /> <br />-2- <br />
