Shares have been obtained from the <br />~ <br />~j <br />~ Corps of Engineers of three ditch companies, but the amount of <br /> <br />water yielded will be minor. In addition a 5,000 acre-foot storage <br /> <br />right from Setchfield Reservoir7 on Muddy Creek has been transferred <br /> <br />to John Martin, but again, the quantity of water which will actually <br /> <br />be yielded is small and very undependable. At present there are <br /> <br />no promising prospects for the rest of the water, but all are given <br /> <br />consideration. <br /> <br />The water could be purchased annually for the initial <br /> <br />filling and evaporation losses from the Fryingpan-Arkansas Project <br /> <br />or other storage sources. This is not really as desirable as <br /> <br />purchase of a water right because it saddles the State Legislature <br /> <br />to an annual appropriation. <br /> <br />After water rights are secured and the Water Court has <br /> <br />its word, there is one big hurdle to pass. The Arkansas River <br /> <br />Compact Administration must approve the operation procedure. <br /> <br />Kansas may take position that such approval is beyond the authority <br /> <br />of the Administration and the Compact will have to be renegotiated <br /> <br />7Setchfield Dam washed out in the 1965 flood and has not been <br />rebuilt. <br /> <br />-13- <br />
