Overaooropriated Surface Supplies. <br /> <br />The surface flows of the Arkansas River in Colorado are <br />greatly overappropriated, and decreed surface rights suffer <br />frequent shortages. Fellhauer v. People, 167 Colo. 320, 447 P.2d <br />986 (1968); Jt. Exh. 157 at 9. Lands under a majority of the <br />canals experience moderate to severe shortages of surface water <br />after June, when the snowmelt is generally gone. Jt. Exh. 92 at i; <br />Colo. Exh. 379. In fact, the river was fully appropriated before <br />the turn of the century, and in most years there is not enough <br />water to provide a full irrigation season supply for any priority <br />dates after 1890. RT Vol. 76 at 42-43, 108-09; Kan. Exh. 16; Jt. <br />Exh. 105 at 34. A USGS report indicates that appropriations total <br />4.2 million acre-feet, compared to an average available supply of <br />about 700,000 acre-feet per year. Jt. Exh. 78. <br /> <br />A Colorado expert witness also testified that the <br />effective surface water supply in Colorado averaged 720,533 acre- <br />feet annually during 1950-85. Colo. Exh. 727*; RT Vol. 116 at <br />33-35. These surface supply figures include tributary inflow as <br />well as mainstream flows from the Rocky Mountains, but do not <br />include groundwater.
