"', <br />\",,---, <br /> <br />c:':"J <br />..-"\ <br />.~,... <br /> <br />Each of the above characteristics affects, to some degree, the <br /> <br />Company's authority with respect to the implementation of <br /> <br />salinity control measures. <br /> <br />The following Sections of this Part <br /> <br />II address the salient and most significant issues of purpose, <br /> <br />assessment, eminent domain and control over shareholders. <br /> <br />B. Authorized Purposes. <br /> <br />The Articles state the purposes for which the Company is <br /> <br />organized, as follows: <br /> <br />To purchase and acquire all the franchises, <br />rights-of-way, canals, ditches, laterals, water rights <br />and property of the Grand River Ditch Company, Grand <br />Valley Canal Company, the Mesa County Di 1:ch Company, <br />the Pioneer Extension Ditch Company, and the <br />Independent Ranchrnen I s Di tch Association, and to <br />operate, manage, control, build, add to, extend and <br />complete said canal system when purchased. <br /> <br />To furnish to and <br />stockholders of the Company <br />and domestic purposes. <br /> <br />distribute among the <br />water for their irrigation <br /> <br />To use, operate, rent, sell, or otherwise dispose <br />of any water power, or water for furnishing power or <br />operating machinery, which the Company may have or <br />obtain in connection with its canals or water systems. <br /> <br />In its operations, not only has the Company not .;renerated or sold <br /> <br />power, the Company has not claimed or exercised any ownership or <br /> <br />right of control over lateral ditches taking water from the main <br /> <br />canals. It has been the interpretation of the Company, supported <br /> <br />by language in Article Third of the Articles, that the use of the <br /> <br />term "lateral" in stating the purposes of the Company is intended <br /> <br />to refer to some of the main canals, which themselves are <br /> <br />"branches" or "laterals" of the other main canals. <br /> <br />8 <br />
