Private Ditch Companies. <br /> <br />(a) Grand Valley Water Users Associatior.. <br /> <br />The Government Highline Canal and its associated "Government <br /> <br />Laterals" were constructed by the United States as a reclamation <br /> <br />project. Ownership of the canal and government laterals remains <br /> <br />in the United States. They are operated by the Grand Valley Water <br /> <br />Users Association (the "Association") under operation and <br /> <br />maintenance contract. <br /> <br />The Association is presently operating and maintaining the <br /> <br />laterals which were enclosed in pipe during Phase I of the Grand <br /> <br />Valley Unit. All ditches (laterals) from the Government Highline <br /> <br />Canal other than the Government Laterals are utilized to conduct <br /> <br />water of the other Subject Canals for the benefi1: of the persons <br /> <br />entitled thereto. Because the Association is the present operation <br /> <br />and maintenance agent for the United States for ,the Government <br /> <br />Highline and Government Laterals, it is assumed for purposes of <br /> <br />this report that it will continue to perform such function. <br /> <br />In addition to pumping and other facilities for transfer of <br /> <br />water carried in the Government Highline to the four other canal <br /> <br />systems in the Grand Valley, there are some 43 headgates from the <br /> <br />Government Highline which serve users of water decreed to the Stub <br /> <br />and Price Canals. The Association merely transports the water, <br /> <br />pursuant to carriage contracts, to the said pumping facilities and <br /> <br />headgates and exercises no jurisdiction or control over such water <br /> <br />once it has left the Government Highline Canal. <br /> <br />-26- <br />
