DESIRABLE FEATURES OF PROPOSED ORGANIZATIONS <br /> <br />As a preliminary matter, we have attempted tc identify <br /> <br />features which are either essential or convenient for the Proposed <br /> <br />Organization(s) as a means of comparing the desirability of the <br /> <br />various available organizations. We believe such features would <br /> <br />include the following: <br /> <br />1. Perpetual existence; <br /> <br />2. Areal jurisdiction as small as practicable with <br /> <br />maximum local control; <br /> <br />3. The authority to make and collect charges or tolls <br /> <br />to defray costs of operation and maintenance; <br /> <br />4. Power to obtain necessary property rights and <br /> <br />interests by condemnation; <br /> <br />5. Authority (whether contractual or jurisdictional) <br /> <br />to require a water user to be subject to charges <br /> <br />for, and rules of administering the delivery of <br /> <br />water; and <br /> <br />5 The interests of water users in a lateral vary considerably. <br />For example, users in the upper reaches of a latE!ral have often <br />become accustomed to an inordinately generous proportion of the <br />water which they are reluctant to forego. In some instances, <br />irrigation is accomplished by a user directly from an open, lined <br />lateral ditch by use of plastic "dams" and hoses. which would not <br />be possible from a buried pipe. In addition, thE! existence of an <br />open, flowing lateral ditch sometimes affords a place for watering <br />of livestock which also would be precluded by an enclosed pipe. <br /> <br />-8- <br />
