Further, it is not the intent of this' <br /> <br />provision to preclude Ranchers from exercising their senior <br /> <br />rights against any or all junior existing conditional or <br />future rights on the Colorado River or its tributaries or to <br /> <br />supersede those rights guaranteed to Ranchers by C.R.S. 1973, <br /> <br />37-86-113. <br /> <br />Further, Subdistrict agrees not to oppose the <br /> <br />application for minimum stream flow made by the Colorado <br /> <br />Water Conservation Board for this purpose if the same is not <br /> <br />in conflict with the provisions hereof, and to assist in <br /> <br /> <br />supporting the integrity thereof, if necessary. <br /> <br />Subdistrict agrees to the installation, at no cost <br /> <br /> <br />to Ranchers, of a stream gaging station on the Colorado River <br /> <br /> <br />in .the vicinity of the present diversion structure of the <br /> <br /> <br />Kinney-Barriger Ditch, and at such other points on the Colorado <br /> <br />River as may be necessary as determined by State Engineer and <br />the Colorado Water Conservation Board, to adequately monitor <br />the minimum stream flows as set forth in this paragraph. <br /> <br />I <br />25. Subdistrict agrees to subordinate its Windy <br />) <br />Gap decrees to all present and:future in-basin irrigation, <br />J <br />domestic and municipal uses, excluding industrial uses, on <br /> <br />the Colorado and Fraser Rivers and their tributaries above <br /> <br />the Windy Gap Reservoir site. <br />26. Subdistrict agrees that no additional water or <br /> <br />water supplies will be carried through the Windy Gap facilities <br /> <br /> <br />unless such conveyance complies with the provisions of C.R.S. <br /> <br />1973, 37-45-118 (I) (b) (IV). <br /> <br />27. Subdistrict will cooperate with all parties in <br />permitting public use for recreational purposes of the land <br />owned by Subdistrict at the Windy Gap Reservoir site upstream <br />of the diversion dam, provided that the operational integrity' <br />of the Windy Gap Project is maintained and the safety of the <br />public is protected.
