<br />crement's pro rata share of the allocable annual operation, mainte-
<br />nance, and replacement cost.
<br />Subsection (b), paragraph (1), provides that the Secretary shall '
<br />defer, without interest, the repayment of construction costs within
<br />the capability of the land to repay which are allocable to each
<br />tribe's agricultural water allocation from the two projects as pro-
<br />vided in the Leavitt Act (25 U.S.C. 368a)and the Colorado River
<br />Storage Project Act. Such costs beyond the capability of the land to
<br />repay are to be repaid as provided in subsection (g). It further pro-
<br />vides that the tribe's share of the operation, maintenance, and re-
<br />placement costs allocable to its agricultural allocation shall be born
<br />by the Secretary, without reimbursement by the tribe, until the
<br />tribe first uses water, either directly or under a water lease con-
<br />tract.
<br />Paragraph (2) provides that, as an increment of water is first
<br />used by the tribe, it shall begin bearing the increment's pro rata
<br />share of the allocable annual operation, maintenance, and replace-
<br />ment costs. It further provides that, any time such water is, used by
<br />a tribal lessee on non-Indian land, the tribe shall bear that incre-
<br />ment's pro rata share of agricultural irrigation construction costs
<br />within the capability of the land to pay as established in subsection
<br />(b)(l).
<br />Subsection (c), paragraph (1), provides that the Secretary shall
<br />bear any increased annual operation, maintenance, and replace-
<br />ment costs to the Animas-La Plata water users made necessary by
<br />the decision of either tribe not to take its project water from the
<br />Ridges Basin Pumping Plant pursuant to the Agreement until the
<br />water is first used by the tribe, either directly or pursuant to a
<br />water use contract. Such cost is not to be reimbursable by the
<br />tribe.
<br />Paragraph (2) provides that, as an increment of such water is
<br />first used by the tribe, the tribe shall begin bearing that incre-
<br />ment's pro rata share of the annual operation, maintenance, and
<br />replacement costs, if any.
<br />Subsection (d) provides that the Secretary may defer all or a part
<br />of the tribal construction obligation and bear all or a part of the
<br />tribal operation, maintenance, and replacement obligation if the
<br />tribe can demonstrate that, it cannot meet those obligations either
<br />out of gross revenues from water use contracts for use of water
<br />from either the Animas-La Plata Project or the Dolores Project or
<br />from the tribe's own use of the water.
<br />Subsection (e) provides that, for the purpose of this section, water
<br />use shall be deemed to occur in any water year in which the tribe
<br />actually uses the water or during the term of a water use contract.
<br />A water use pursuant to a contract under which the tribe only re-
<br />ceives income in the nature of a standby charge is deemed not to
<br />be a water use.
<br />Subsection (0 authorizes to be appropriated such sums as are
<br />necessary for the Secretary to pay the annual operation, mainte-
<br />nance, and replacement costs as provided in this section.
<br />Subsection (g) provides that that portion of the costs of the
<br />Animas-La Plata Project in excess of the ability of the water users
<br />to pay shall be repaid from the Upper Colorado River Basin Fun~
