<br />41~3 <br /> <br />judgment of the court, the parties have agreed that the Tribe's <br />vater right and breach of trust c:laims on the Mancos, Animas, and <br />La Plata Rivers can be revived if the Dolores projec:t (for the <br />Mancos River) or the Animas-La Plata Project (for the Animas and <br />La Plata Rivers) is not c:ompleted. <br /> <br />Pursuant to the agreement, necessary enactments by Congress <br />include: Waiver of the Non-Intercourse Act: project c:onstruc:tion <br />costs'deferrals: project operation, maintenance and repair cost <br />deferrals; vaiver of federal reclamation lav: authorization and <br />appropriation of $49.5 million for the Tribal Development :unds; <br />vaiver of the Tribal vater right claims (provided that the ~a:ver <br />of the c:laims relative to the Animas and La Plata Rivers are nOt <br />final until the Animas-La Plata Project is construc:ted and the <br />vaiver of the claims relative to the Manc:os River are not e!!ec:- <br />tive until the combined Highland-Tovaoc Canal is c:onstructed); <br />and a directive to the Secretary of the Interior to comply ~ith <br />the administrative article. <br /> <br />Necessary Colorado legislative enactments include: Author- <br />ization and appropriation of $5 million to the Tribal Develo~oe~: <br />Fund: authorization of the amount necessary to complete the <br />Tovaoc: pipeline and domestic: vater distribution system; and <br />authorization and appropriation of S5.6 million for the c:~ns:ruc- <br />tion of project fac:ilities. The Colorado General Assembly has <br />already authorized the money nec:essary for the c:onstruc:tion c: <br />the Toyaoc: pipeline and domestic: vater distribution system. <br /> <br />Article VI - General Provisions <br /> <br />The last article of this document includes miscellanec~s <br />agreements.
