<br />4120 <br /> <br />Summary of the <br /> <br />COlorado Ute Indian Water Rights <br />Final Settlement Agreement of December 10, 1986 <br /> <br />The Agreement consists of seven articles: general purposes, def- <br />initions, quantification and deter.:ination, administration, leas- <br />ing and off-reservation use, finality of settlement, and gene~al <br />provisions. <br /> <br />Article I - General Purposes <br /> <br />This article provides a brief introduction to the docume~~ <br />and sets out its general purposes vhich are: (1) the set~leme~: <br />of existing disputes or future controversies concerning ~he <br />Tribes' right to beneficially use vater in southvest Colorado; <br />(2) the settlement of the litigation filed by the United Sta~es <br />on behalf of the Tribes in the Colorado Oistrict Court for wa:e~ <br />Division No.7; (3) the enhancement of the Tribes' oCtlor~'o.\n:~:es <br />to derive an economic benefit from the use of their ~ese~ved <br />vater rights; (4) the enhancement of the Tribes' abili~y to ::tee: <br />their repayment obligations under the Agreement; and (5) the <br />authorization for the Tribes to sell, exchange, lease o~ o~he~- <br />vise temporarily dispose of thei~ vater. <br /> <br />Article II - Definitions <br /> <br />This article includes the Agreement's glossary of :e~::ts. <br /> <br />Artic~e III - Quantification and Oe:er~i~a:ion <br /> <br />Under the terms of the Agreement, the Ute Hounta:~ v~e <br />Indian T~ibe vill receive the right to beneficially use 25.1:C <br />acre-feet of vater from the Dolores Projec~, 33, 000 acre-fee: of <br />vater from the Animas-~a Plata Project, and 27,~00 acre-fee: of <br /> <br />
