We believe that <br /> <br /> <br />we can now accurately predict the future operation of the projected <br /> <br /> <br />Closed Basin Project and that such operation will not affect existing <br /> <br /> <br />water rights, except to improve upon them. However, to eliminate any <br /> <br /> <br />suspected adverse effect, special safeguards have been written into <br /> <br /> <br />the pending legislation which are vital to the residents of the <br /> <br /> <br />valley and which we urge be retained as now set forth. <br /> <br /> <br />The project report indicates that it might take a period <br /> <br /> <br />in excess of forty years after the project becomes operational for <br /> <br /> <br />Colorado to achieve a debit-free status under the compact. The <br /> <br /> <br />report also contemplates that Colorado will accumulate further debits <br /> <br /> <br />in future years. This projected method of operating the project was <br /> <br /> <br />objectionable to the States of New Mexico and Texas. <br /> <br />In order that the project would have more favorable benefits <br /> <br />for the States of New Mexico and Texas, the State of Colorado has <br /> <br /> <br />proposed the priorities and limitations set forth in Section 4 of the <br /> <br /> <br />pending legislation. Under our projected operation of the project <br /> <br /> <br />pursuant to Section 4. a reasonable prediction of the time required <br /> <br /> <br />to eliminate the accumulated debit would be a period of from ten to <br /> <br /> <br />fifteen years after the project becomes operational. Under our <br /> <br /> <br />assumption, we would not be permitted to accumulate any further debits. <br /> <br /> <br />Based upon this major modification of the proposed project operation, <br /> <br />-9- ' <br />
