<br />0024;)2 <br /> <br />2) establish a ten member advisory committee to offer advice as <br />requested to the Executive Director of the Department of <br />Natural Resources; <br /> <br />3) require a permit for each project in addition to a license; <br /> <br />4) specify requirements for licenses and permits; <br /> <br />5) require publication of proposed project plans and a public <br />hearing in the area to be affected before a permit could be <br />approved; <br /> <br />6) empower the Executive Director to set project operational <br />limitations to modify or suspend the project when warranted; and <br /> <br />7) initial appropriation for fiscal year 1973 of $18,000, which <br />included $15,000 annual appropriation, and $3,000 to allow <br />immediate implementation. <br /> <br />The Colorado Weather Modification Act of 1972 <br /> <br />A bill controlling weather modification was passed as proposed by the Legislative <br /> <br />Council COlll1littee with minor changes. It is Title 36 Article 20 in the Colorado <br /> <br />Revised Statues of 1973. The new law appropriated $15,000 to be spent as follows: <br /> <br />TOTAL <br /> <br />$4,700 <br />2,350 <br />1,700 <br />6,250 <br />$15,000 <br /> <br />f <br /> <br />Twelve advisory committee meetings and hearings <br /> <br />Six public hearings for issuance of permits <br /> <br /> <br />Court reporters, hearing officers, etc. if needed <br /> <br />Consulting fees for qualified experts <br /> <br />The Act was amended ~n 1979 changing the penalty for conducting illegal weather <br /> <br /> <br />modification from a misdemeanor to a Class V felony. Illegal seeding was defined <br /> <br /> <br />as operating without the required license and permit and contracting or paying <br /> <br /> <br />another person known to be unlicensed or without a permit to conduct weather <br /> <br /> <br />modification operations. This amendment, sponsored by Representative James <br /> <br /> <br />Lillpop (R), Alamosa, was a response to increased concern in the San Luis Valley <br /> <br />over possible illegal seeding activity. <br /> <br />11 <br />
