<br />002112 <br /> <br />maintain this insurance; maintain adequate insurance on any materials, parts, assemblies, <br />subassemblies, supplies, equipment, and other property acquired for or allocable to each <br />Contract; and furnish any certificates with respect to its insurance that the administering office <br />may require. <br /> <br />7. Additionally, claims arising out of a Construction Contract for the individual project <br />features will be processed in accordance with the procedures then in effect for the Department of <br />the Interior relating to claims under the FTCA. <br /> <br />8. Costs for the insurance described above shall be included in the fixed-price of each <br />Construction Contract for the individual project features. <br /> <br />I. Retrocession by the Tribe. The Contractor may return to Reclamation any portion of a <br />Construction Contract for any reason, before the expiration of the term of the Contract. <br /> <br />In the event of a retrocession, Reclamation may reacquire from the Contractor any government- <br />furnished property or acquire title to contractor-purchased property used in the performance of <br />the retroceded project(s). The Contractor shall retain title to any excess or surplus government <br />property acquired from other agencies. On the effective date of any retrocession, the Contractor <br />shall, at the request of Reclamation, return to Reclamation all requested property and equipment <br />provided for use in the retroceded project which have a per-item current fair market value, less <br />the cost of improvements borne by the Contractor, in excess of$5,000 at the time of the <br />retrocession. <br /> <br />J. Buy American Act. To the greatest extent practicable, all equipment and products <br />purchased with funds made available under each Construction Contract should be American- <br />made. <br /> <br />K. Lobbying Restrictions. None of the funds provided to the Tribe under each <br />Construction Contract may be used in any way, directly or indirectly, to influence Congressional <br />action on any legislation or appropriation matter pending before Congress, other than to <br />communicate to Members of Congress as described in section 1913 oftitle 18, United States <br />Code. <br /> <br />L. Federal Acquisition Regulations (FAR) Clauses. The FAR clauses, Clauses Adapted <br />from FAR clauses, and their associated provisions, included in Part ill, are incorporated into this <br />contract, as indicated for applicability between Reclamation and the Contractor, the Contractor <br />and subcontractors, or both. <br /> <br />M. Design and Construction Management Expenditures. In order to reduce project costs <br />associated with 638 undertakings, Reclamation agrees to implement its design and construction <br />management responsibilities in the most economical and efficient manner possible.
