<br />OG2102 <br /> <br />If Reclamation terminates a Construction Contract for convenience, Reclamation shall provide <br />the Contractor 21 days advance written notice of intent to terminate a contract for convenience. <br />The Contractor shall be compensated for reasonable costs incurred due to termination ofthe <br />contract. <br /> <br />L. Property. The property management standards and requirements specified in 25 CFR <br />900.51-60 and 25 CFR 900.85-107 shall apply to this Contract. A list of property, facilities, and <br />equipment to be furnished by Reclamation under an individual Construction Contract, as <br />Government-furnished property, as mutually agreed to and accepted by both parties, shall be <br />included as an attachment to the contract. This list shall be kept current and provided to both <br />parties for the duration of the Contract. <br /> <br />1. Excess and Surplus Property. The Contractor may request donation of excess and <br />surplus Government property for its authorized use under this Contract. The Contractor must <br />submit such request to Reclamation for coordination with the General Services Administration <br />(GSA), the Indian Health Service (illS) and/or the Bureau of Indian Affairs (BlA). <br /> <br />2. Accountability for Property. The Contractor's property management system shall <br />account for all property furnished by Reclamation for use under this Contract, or acquired with <br />Contract funds. <br /> <br />3. Disposition of Property. The Contractor shall notifY Reclamation and follow <br />25 CFR 900.60 to dispose of any government-owned personal property being used by the <br />Contractor in the performance of this Contract. <br /> <br />4. Real Property. Under Reclamation law, Reclamation does not have authority to <br />transfer title to real property. The title to any real property acquired in whole or in part with <br />Contract funds, or of any facilities or structures constructed with Contract funds, shall remain <br />with the Federal government, unless Congress specifically authorizes title to such property to be <br />transferred to the Contractor. <br /> <br />5. Upon completion of all work under this Contract, at its option, Reclamation may elect <br />to reacquire government-furnished property or acquire title to contractor-purchased property or <br />Contractor purchased property used in the performance of this Contract, in accordance with 25 <br />CFR 900.89 and 25 CFR 900.93. <br /> <br />M. Procurement. <br /> <br />1. General Procurement Standards <br /> <br />(a) The Contractor shall make procurement awards only to responsible entities <br />who have the ability to perform successfully under the terms and conditions of the <br />proposed procurement.
