<br />002039 <br /> <br />insured by an agency or instrumentality of the United States or must be fully <br />collateralized to ensure protection of the funds, even in the event of a bank failure; <br /> <br />(c) Interest and investment income that accrue on any funds provided for by <br />contract become the property of the Contractor pursuant to section 1 05(b) of the Act. <br /> <br />(d) Nothing in this section shall restrict the Contractor from obtaining profit from <br />such funds under a fixed-price contract and from utilizing such profit free of any contract <br />restrictions. <br /> <br />J. Minor Interruptions and Delays in the Work. Minor interruption and delays in the <br />work may result during the course of the testing, inspection, and quality assurance monitoring <br />(described in Section F.6 above) which will need to be conducted as construction progresses or <br />as a result of encountering differing site conditions which will be subject to FAR 52.236-2, <br />Differing Site Conditions. Such interruptions or delays will be minimized to the maximum <br />extent possible. <br /> <br />K. Suspension of Work and Termination of Contract Performance. <br /> <br />1. Suspension of Work Resulting from Congressional Action or Inaction. Reclamation <br />can require the Contractor to suspend work under each Construction Contract in accordance with <br />this paragraph. <br /> <br />(a) The following are reasons Reclamation may suspend work under a <br />Construction Contract: <br /> <br />(1) Funds allocated for the project that is the subject of this Contract are <br />rescinded by Congressional action; or <br /> <br />(2) Other Congressional actions occur that materially affect the subject <br />matter of the contract. <br /> <br />(b) The Contractor shall be compensated for reasonable costs, including but not <br />limited to overhead costs, incurred due to any suspension of work that occurred through <br />no fault ofthe Contractor. <br /> <br />(c) Disputes arising as a result ofa suspension of the work by Reclamation shall <br />be subject to the Contract Disputes Act or any other alternative dispute resolution <br />mechanism as negotiated between and agreed to by the parties and contained in the <br />contract. <br /> <br />2.
