Beise) <br /> <br />SOl1E DECISIONS BEARING ON CLAIM OF DENVER'- DISTRICT <br /># 36 - BLUE RIVER. <br /> <br />The <br />following <br /> <br />quoted portions of decisions hereto attached are my authority for the <br />observations regarding Denver's' claim: <br /> <br />1. <br /> <br />Refilling or double filling of reservoir is improper <br /> <br />a. Should we offer in evidence certified copies of decrees for all <br />reservoirs mentioned in Denver's claim which all ready have de- <br />creed rightsf <br /> <br />2. Pleading of eachange of water is improper in an adjudication proceeding. <br /> <br />3. Forme,,' decrees in adjudication are res adjudicata only as to parties, in <br />former proceeding. <br /> <br />4. A claim for domestic use or electricity should not be file~ i~,m proceed_ <br />ing adjudicating irrigation rights. <br /> <br />5. Original filing for tunnel for direct flow cannot be changed to basis for <br />a storage claim. <br /> <br />6..
