December 4, <br /> <br />1973e <br /> <br />. <br /> <br /> <br />.. <br /> <br />STATE ENGINEER'S POSITION <br /> <br />The very nature of this problem is so complex that different areas <br />must be treated in a different way in order to accomplish the intent of the <br />legislature, namely, to maximize the beneficial use of all of the waters of <br />the state and by the same token protect existing water rights. New well <br />permits, other than those granted for alternate points of diversion or changes <br />in point of diversion are not being granted in areas south of the "hydraulic <br />divide" (approximately three miles north of the Rio Grande) since these wells <br />would intercept return flow to the natural stream, diminishing the surface <br />run off at Lobatos Gaging Station to the detriment of prior vested rights. <br />New well permits, except as alternate points of diversion or changes in <br />pOints of diversion, are not being granted above the periphery of the con- <br />fining blue clay stratum because this area is considered to be the source of <br />recharge for the confined or artesian aquifer. New well permits are being <br />granted in ilfeas of the closed basin where the lowering of the water table <br />will prOvide salvage water and not be injurious to a prior vested water right. <br />
