In fact, all I did <br />was put my notes together from the Weather Modification Association's elements of <br />a "state" model law (1968 and 1969), the pUb1ication and notes on the "Davis" <br />Weather Modification Control Law (1976), my notes from Dean Mann's presentation <br />at the AAAS/ABA Duke Conference (March 1976), and the testimony presented at the <br />1976 Weather Modification Hearings of the Subcommittee on the Environment and the <br />Atmosphere, Committee on Science and Techno109Y, U.S. House of Representatives <br />(June 15-18, 1976). <br /> <br />Weather Modification Association (WMA) Model Law <br />A special committee (R.A. Schleusener, R.D. Elliott and T. Johnson) of the <br />WMA drafted model state legislation in the fall of 1967 (about twenty years after <br />cloud seeding started). The motivation for providing elements for a state model <br />law was to provide information on the features that were considered desirable to <br />accomplish the major objectives of the WMA. It is important to realize that the <br />following elements would be applicable t.o Federal legislation and that all three <br />,sectors (government, private, and university) of the WMA approved these on 19 <br />February, 1969 (ei ght years age.); <br />Briefly, the elements included: <br />1. Purpose - provide statements showing economic benefit, activities <br />should be encouraged, proper safeguards, not an ultra-hazardous activity, <br />does not constitute trespass, and does not involve an actionable nuisance. <br />2. Definition - like changes in the composition, behavior, or dynamics of <br />the atmosphere which are artificially and intentionally induced. <br />3. Board - should consist of members chosen mainly from private life who <br />represent interests concerned with water resources as they affect <br />agriculture and industry. Technical competence in meteorology or <br />related scientific field should also be represented; however, no <br />
