<br />002040 <br />Durango Pumping Plant Stage I <br /> <br />Amendment 001 <br /> <br />Fuel Usage Factors (FU) - Table I contains the items for which adjustments may be made, <br />and the fuel usage factors upon which the adjustment will be based. The adjustment will be determined on appropriate items in the <br />above list using the formula with the following constraints: <br /> <br />1. The Partial Estimate Base Price must change plus or minus 15 percent from <br />the Contract Base Price before an adjustment will be made. <br /> <br />2. An amount of 5 percent will be added or subtracted per the formula (below). <br /> <br />( <br /> <br />3. Only items listed in table I will be adjusted. <br /> <br />4. Adjustments in compensation may be either plus or minus depending on the <br />differences between the Contract Base Price (CP) and the Partial Estimate <br />Base Price (EP). <br /> <br />Work Bevond Contract Time - No adjustment will be allowed for any partial estimate falling <br />wholly after the expiration of contract time plus approved time extensions. <br /> <br />Upward Ceiling - If the Partial Estimate Base Price increases by more than 50 percent from <br />the Contract Base Price for an adjustment item, the CO will make a determination whether or <br />not it is feasible for the remainder ofthe project to proceed and will notify the Contractor in <br />writing if the contract is to be terminated. <br /> <br />Adiustment Formula- <br /> <br />EP greater than CP: <br /> <br />AF = [(EP-CP) - 0,05 CPl 0 (FU) <br />42 <br /> <br />EP less than CP: <br /> <br />AF = [(EP-CP) + 0.05 CPl 0 (FU) <br />42 <br /> <br />- 17 - <br />
